Terms of Service

These Terms of Service (“Terms”) govern your use of the website, booking platform, sessions, and services provided by Zack’s VR Arena (“we,” “our,” or “us”). By booking a session, using our website, or entering our facility, you agree to be bound by these Terms.

If you do not agree, please do not proceed with booking or visiting.

2.1 When you make a booking, you agree to pay the price specified at the time of booking.

2.2 Booking is confirmed only after payment has cleared and you receive confirmation from us.

2.3 You agree that the information you provide is accurate and that you have the authority to make the booking.

2.4 All tickets or bookings remain our property and cannot be transferred, resold, or used for commercial purposes unless we approve in writing.

3.1 For standard sessions: Cancellations or reschedules must be made at least 24 hours before scheduled time to be eligible. Otherwise you forfeit the session.

3.2 For group events or parties: A non-refundable deposit may apply; cancellations within 48 hours of the event are not eligible for refund or credit.

3.3 If we must cancel or reschedule due to operational issues, safety, or emergency, you will be offered either a full refund or complimentary reschedule.

3.4 We do not refund for change of mind, late arrival, or no-shows unless explicitly stated.

4.1 Please arrive at least 10 minutes before your scheduled time to check-in and complete safety briefing.

4.2 If you arrive late and session has already begun, your play time may be reduced or forfeited.

4.3 No-shows will not receive credit or refund.

5.1 Participation in VR experiences involves inherent risks including falls, collisions, motion-induced dizziness/ nausea, equipment malfunction, or other injuries.

5.2 By participating, you assume all such risks, whether foreseeable or not.

5.3 You release Zack’s VR Arena, its owners, staff, subsidiaries, affiliates, contractors (“Released Parties”) from any and all claims, whether for personal injury, property damage, or other loss—to the extent permitted under South Carolina law.

5.4 If you make this booking on behalf of another participant (including a minor), you represent you have authority to bind them and accept all terms on their behalf.

6.1 Players under 16 years old must be accompanied by a parent or guardian.

6.2 You must be in good health, free of conditions (e.g., heart problems, epilepsy, fractures) which may impair safe participation.

6.3 Participants who are pregnant or under the influence of alcohol or drugs will be denied participation without refund.

6.4 You agree to follow all staff instructions, warning signs, equipment guidance, and safety boundaries. Failure to comply may result in termination of participation without refund.

7.1 You accept responsibility for proper use of all VR equipment provided. Misuse, damage, or neglect may result in charges for repair or replacement.

7.2 You must act responsibly and respectfully towards staff, other participants, and equipment. Reckless or unsafe behavior may lead to removal, termination of session, and loss of refund.

7.3 Personal items: We are not responsible for lost, stolen, or damaged personal objects. Please secure your belongings.

8.1 By participating, you consent to being photographed or filmed on our premises for security, marketing, promotional or social-media uses unless you expressly opt out.

8.2 Use of our website and services is also governed by our separate Privacy Policy which explains how we collect, use, and share your personal data.

9.1 All content on our website including logos, designs, text, images, and trademarks is owned by Zack’s VR Arena (or its licensors) and is protected by copyright and trademark laws.

9.2 You are prohibited from copying, distributing, modifying, or creating derivative works of our content without written permission.

9.3 You agree not to misuse the website, interfere with its operation, or attempt to gain unauthorized access.

10.1 To the fullest extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of our services or participation in sessions.
• Our liability for any direct damages is limited to the amount you paid for the booking.

10.2 Nothing in these Terms excludes liability for death or personal injury caused by our negligence to the extent not permitted by law.

11.1 We reserve the right to cancel, suspend or terminate your access to our services, booking privileges, or facility without notice if you breach these Terms, engage in unsafe behavior, or damage property.

11.2 Termination does not relieve you of obligations incurred before termination, including payment of fees or liability for damage.

These Terms are governed by the laws of the State of South Carolina.

Any disputes arising under or in connection with these Terms shall be subject to the jurisdiction of the courts in South Carolina.

We may update these Terms from time to time. The revised date will be listed at the top of this document. By continuing to use our website, make bookings or participate in sessions after the revision date, you agree to the updated Terms.
